Understanding Spousal Support

Spousal support, often referred to as alimony, is a financial payment one spouse may be required to make to the other after separation or divorce. In Ontario, the determination of spousal support is governed by the federal Divorce Act and the provincial Family Law Act. The stated objectives are to address economic disparities resulting from the relationship, compensate for sacrifices made during the marriage, and assist the recipient to transition toward financial independence. Eligibility isn't automatic; factors such as the length of the relationship, roles during the marriage, and each spouse's financial situation are considered. It's important to note that both married and common-law partners may be entitled to spousal support under certain conditions.

Factors in Calculating Spousal Support

Determining the amount and duration of spousal support involves a complex analysis of various factors. The Spousal Support Advisory Guidelines (SSAG) serve as a reference point, providing ranges for support amounts and durations based on the length of the relationship and the income disparity between spouses. For instance, in relationships without children, support duration may range from half to one year for each year of cohabitation, with indefinite support considered in longer marriages or when the recipient's age plus years of marriage equals 65 or more. However, courts have discretion to deviate based on the unique circumstances of each case in exceptional circumstances. Tax implications also vary: periodic payments are typically taxable for the recipient and tax-deductible for the payer.
