Family law clients are often asked to make important financial and parenting decisions at a time when they are already under considerable stress. Uncertainty about legal fees can make that experience even more difficult.

At the Family Law Office of Isaac Paonessa (“Paonessa Law”), we believe clients should understand:

• what work needs to be done;

• who will be responsible for completing it;

• how legal fees will be charged;

• what the next stage of the case is likely to involve; and

• when an important decision or additional retainer will be required.

 

Not every family law matter can be handled for a fixed fee. Contested cases can change quickly depending on the conduct of the other party, the disclosure received, the positions taken by opposing counsel, and the directions or Orders made by the Court.

However, greater cost predictability is often possible when the legal work can be clearly defined. Depending on the circumstances, Paonessa Law may offer hourly billing, fixed fees, capped fees, limited-scope retainers, or retainers divided into manageable litigation stages.

Paid Initial Strategy Consultation

​

A strategy consultation is more than a general introductory conversation. It is a focused meeting with a family lawyer intended to help you understand your legal position and identify the decisions that should be made next.

Before the consultation, you may be asked to provide background information and relevant documents so that the meeting can be used productively.

​

During the consultation, we may discuss:

​

• your immediate rights and obligations;

• parenting, support or property concerns;

• urgent risks or upcoming deadlines;

• whether additional disclosure is required;

• negotiation, mediation or court options;

• the likely stages of the case; and

• the type of legal retainer that may be appropriate.

 

Where possible, you should leave the consultation with a clearer understanding of your options, your priorities and the next practical step.

Defined-Scope Financial Disclosure Preparation

​

Financial disclosure is one of the most important—and frequently underestimated—parts of a family law case.

Incomplete or poorly organized disclosure can delay negotiations, increase legal fees and weaken an otherwise reasonable position. In appropriate cases, Paonessa Law may be retained for the defined purpose of helping a client prepare, organize or respond to financial disclosure.

The scope may include:

​

• preparing or updating a Financial Statement;

• identifying the supporting records that should be produced;

• organizing income, property and debt information;

• preparing a Certificate of Financial Disclosure;

• reviewing disclosure requests;

• identifying missing or potentially relevant documents; and

• preparing a structured response for delivery to the other party or counsel.

 

The scope of the assignment, the responsibilities of the client and the limits of the retainer will be confirmed in writing.

Fixed-Fee Simple/Uncontested Divorce

 

Where all other issues have been resolved and only a divorce is required, Paonessa Law may offer a fixed fee for an uncontested divorce.

​

An uncontested divorce may be appropriate where there is no dispute about parenting, support, property or any other claim that must be decided by the Court.

​

The fixed-fee arrangement will identify what is included, such as preparation of the required divorce documents, filing coordination and obtaining the Divorce Order. Court filing fees, process-server fees, certificates and other third-party expenses may be charged separately.

​

Before accepting the matter on a fixed-fee basis, we will confirm that the divorce is genuinely uncontested and that no unresolved issue is likely to interfere with the application.

​

Fixed-Fee Independent Legal Advice

​

Independent legal advice is not simply the signing of a certificate.

​

The lawyer must review the proposed agreement, understand the client’s circumstances, explain the legal effect of the agreement and identify provisions that may create significant risk.

​

Where a separation agreement, marriage contract, cohabitation agreement or other domestic contract is already substantially complete, Paonessa Law may offer independent legal advice for a fixed fee.

​

The service may include:

​

• reviewing the agreement and relevant financial disclosure up to a certain number of pages;

• meeting privately with the client;

• explaining the client’s legal rights and obligations;

• identifying unusual, unclear or potentially unfair provisions;

• discussing the consequences of signing;

• recommending limited revisions where required; and

• signing a Certificate of Independent Legal Advice where appropriate.

 

A fixed fee generally assumes that the agreement is substantially complete, the disclosure is organized and the requested revisions are limited. Substantial negotiation, redrafting or missing disclosure may require a revised scope or a separate retainer.

Staged Retainers for Contested Family Law Cases

​

Contested family law proceedings are usually billed hourly because the amount of work required cannot always be predicted in advance.

​

However, that does not mean the entire case must be funded through one large, open-ended retainer.

Where appropriate, Paonessa Law may divide a contested matter into stages, with a separate retainer and budget discussion before each major phase.

​

The stages may include:

​

1. initial assessment and urgent advice;

2. financial disclosure and information gathering;

3. negotiation and settlement proposals;

4. preparation or response to court documents;

5. a case conference or settlement conference;

6. a motion or other contested hearing; and

7. trial preparation and trial representation.

 

This staged approach allows the client and lawyer to reassess the case as new information becomes available. It also creates natural decision points at which the likely benefit, cost and risk of the next step can be considered.

 

A staged retainer is not a guarantee of the final cost of a contested proceeding. It is a method of improving planning, accountability and communication as the case develops.

Capped-Fee Drafting and Document Review

​

Some legal assignments are narrow enough that the amount of work can be reasonably controlled.

In suitable cases,we may agree to complete a defined drafting or review assignment subject to a fee cap.

​

Examples may include:

​

• reviewing a proposed separation agreement;

• drafting a settlement proposal;

• preparing a response to a specific letter;

• reviewing a Financial Statement;

• preparing defined court documents;

• revising proposed Minutes of Settlement; or

• providing written advice on a specific family law issue.

 

A capped fee means that fees will not exceed the agreed amount unless the client approves a change in scope.

The fee cap will be based on stated assumptions. For example, it may assume that the documents provided are complete, that only one draft and one revision are required, or that the assignment does not expand into ongoing negotiation.

 

If the scope changes, we will discuss the change before undertaking work beyond the agreed limit.

Appropriate Delegation Without Losing Lawyer Oversight

Not every task requires the principal lawyer’s hourly rate.

 

Where appropriate, administrative, organizational and procedural work may be completed by experienced legal staff at a lower hourly rate. This may include document organization, scheduling, preparation of routine correspondence, file management and assembly of financial disclosure.

Delegation is intended to control costs and improve efficiency. It does not mean that legal judgment is delegated.

The lawyer remains responsible for:

​

• legal advice;

• case strategy;

• substantive negotiations;

• review of important correspondence and court documents;

• preparation for hearings; and

• advocacy before the Court.

 

Clients are billed according to who performs the work. The objective is to have each task completed by the appropriate person while maintaining necessary legal supervision.

 

Communication That Helps You Make Decisions

 

Clients should not be left wondering what is happening with their case or why legal work is being performed.

Our communication approach is intended to help clients understand:

• what has happened since the last update;

• what information or instructions are required;

• what the next step is;

• what choices are available;

• what each option may cost;

• what risks are associated with each option; and

• when a strategic decision must be made.

 

Family litigation sometimes requires immediate action. At other times, the most effective decision may be to pause, obtain better disclosure, make a focused settlement proposal or avoid spending more in legal fees than the issue is worth.

 

Good communication includes discussing those distinctions candidly.

 

Choosing the Right Fee Structure

 

The appropriate billing arrangement depends on the nature of the work.

 

Fixed fees may be appropriate where:

​

• the service is clearly defined;

• the necessary information is available;

• the number of required documents or revisions can be anticipated; and

• the involvement of the other party is limited.

 

Capped fees may be appropriate where:

​

• the assignment can be defined;

• some uncertainty remains;

• reasonable limits can be placed on the work; and

• any change in scope can be identified before additional work is completed.

 

Hourly billing is generally required where:

​

• the matter is contested;

• the response of the other party cannot be predicted;

• disclosure is incomplete;

• negotiations are ongoing;

• court attendance may be required; or

• the scope of the work is likely to change.

 

Before a retainer is finalized, we will identify the proposed fee structure, the work included and the circumstances that may require the arrangement to be reconsidered.

A More Deliberate Approach to Family Law

​

The least expensive legal process is not always the best process. A poorly drafted agreement, incomplete disclosure or rushed settlement can create much greater costs later.

​

At the same time, legal work should remain connected to the client’s actual goals and the value of the issue in dispute.

​

The availability of fixed-fee, capped-fee and limited-scope services depends on the facts of the matter, the completeness of the information provided and the firm’s assessment of the work required. A fee arrangement is not confirmed until it is set out in a written retainer agreement.
